1. Parties and Acceptance

This agreement is between you or your organization and Sichuan Zhiqiang Yunfan Technology Co., Ltd. By accessing, using, registering for, purchasing, integrating, or distributing our services, you accept this agreement, our Privacy Policy, and any applicable product-specific terms.

3. Scope of Services

Our services include but are not limited to:

  • Cloud computing technology services.
  • Network technology services.
  • Information technology research and development and related services.
  • Software development services.
  • Big data services.
  • Information system integration services.
  • Research, development, and sales of smart security systems.
  • Enterprise digital solution design and implementation.
  • Sales of computer software and hardware, digital products, and office equipment.
  • Marketing strategy planning services.
  • Business information consulting services.
  • Internet sales (excluding licensed goods).
  • Mobile management application business integrated with enterprise delivery.
  • Publishing and operational support for Google Play, App Store, and other lawful app marketplaces.

4. Account and Access Conditions

  • You must provide accurate and complete information for registration and service onboarding.
  • You are responsible for account credentials, API keys, and endpoint security under your control.
  • You must promptly notify us of unauthorized access, misuse, or security events.
  • We may suspend access for security risks, legal obligations, or material breach of this agreement.

5. Acceptable Use

You agree not to:

  • Use services for unlawful, fraudulent, abusive, or infringing activities.
  • Upload or distribute malware, exploit code, unauthorized tracking tools, or harmful payloads.
  • Attempt unauthorized access, reverse engineering beyond legal limits, or disruption of service infrastructure.
  • Use services to violate export controls, sanctions laws, anti-corruption laws, or regulatory restrictions.
  • Misrepresent identity, affiliation, or rights regarding content and data submitted through the services.

6. Mobile Application and App Store Terms

For mobile management applications and any software released through app stores, you must comply with relevant store and platform rules, including policy updates issued from time to time.

  • Google Play Developer Program Policies and associated user data, billing, and families requirements.
  • Apple App Store Review Guidelines, App Privacy requirements, and age rating rules.
  • Applicable third-party SDK and API terms integrated in your configured delivery stack.
  • You are responsible for truthful store listings, disclosures, screenshots, and legal representations submitted under your publisher profile where you control publication.

7. International Policy and Regulatory Compliance

Service delivery for overseas markets follows jurisdiction-adaptive compliance controls, including but not limited to:

  • European Union and EEA laws including GDPR obligations.
  • United Kingdom data and consumer protection rules.
  • United States federal and state laws including California and other state privacy frameworks.
  • Canada, Brazil, Japan, South Korea, Singapore, Australia, New Zealand, Switzerland, India, and other applicable jurisdiction requirements.
  • Consumer, advertising, e-commerce, cybersecurity, and age-protection rules applicable to app and web operations.

8. Advertising Monetization Terms

Where monetization is enabled, ad integrations may include splash ads, rewarded video ads, interstitial ads, and banner ads. Supported platforms may include Google AdMob, Google Ad Manager, AppLovin MAX, Meta Audience Network, Unity Ads, ironSource, Mintegral, Pangle, InMobi, Chartboost, Liftoff Monetize, Fyber, Smaato, Amazon Publisher Services, Snap Audience Network, Yahoo SSP, and additional lawful providers as configured.

  • You must ensure legal basis and consent management where required for personalized advertising.
  • You must implement age-appropriate controls, child-directed protections, and restricted processing where legally required.
  • You must comply with platform-specific ad policy restrictions, invalid traffic prevention rules, and disclosure obligations.
  • Revenue outcomes are variable and not guaranteed unless expressly stated in a signed commercial contract.

9. Data Protection and Privacy Commitments

Processing of personal data is governed by our Privacy Policy and applicable law. Both parties shall implement appropriate technical and organizational safeguards. Where required, additional data processing agreements or transfer mechanisms may apply.

10. Intellectual Property

  • We retain ownership of our pre-existing intellectual property, methodologies, and internal frameworks.
  • You retain ownership of your data, trademarks, and materials provided to us, subject to rights required to perform services.
  • Deliverable ownership, licensing scope, and source code transfer terms are governed by signed commercial orders or statements of work.

11. Fees, Payments, and Taxes

  • Commercial pricing, payment milestones, and billing terms are defined in contracts, proposals, or purchase orders.
  • Unless otherwise stated, fees are exclusive of taxes, duties, and governmental charges.
  • Late payment may result in service restrictions, delayed delivery, or lawful collection actions.

13. Warranties and Disclaimers

Except as expressly stated in signed commercial documents, services are provided on an as-available basis. We do not guarantee uninterrupted operation, universal app-store approval, or specific commercial outcomes. Nothing in this section excludes non-waivable statutory rights.

14. Limitation of Liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, punitive, special, or consequential damages, including loss of profits, data, business opportunity, or goodwill. Aggregate liability limits may be defined by contract.

15. Indemnification

You agree to indemnify and hold harmless the company against claims arising from unlawful use, policy violations, rights infringement, or misrepresentations in your submitted content, metadata, or app-store materials.

16. Suspension and Termination

  • We may suspend or terminate service access for legal non-compliance, severe risk, or unresolved material breach.
  • You may terminate according to contract terms, required notice periods, and payment obligations.
  • Upon termination, data handling and retention follow legal requirements, privacy commitments, and contract provisions.

17. Export Controls and Sanctions

You must comply with all applicable export control, sanctions, and trade compliance laws. Services may not be used in embargoed regions or prohibited end-use scenarios where law restricts access.

18. Age and Eligibility

  • Enterprise service users must be legally capable of entering binding agreements.
  • Apps intended for minors must include age gating, parental notice, and child-protection controls where required.
  • For child-directed contexts, behavior-based advertising may be restricted or disabled to meet legal and platform standards.

19. Force Majeure

Neither party is responsible for delays caused by events beyond reasonable control, including natural disasters, major network disruptions, governmental actions, war, or severe cybersecurity incidents.

20. Governing Law and Dispute Resolution

Unless otherwise agreed in a signed contract, applicable law and dispute resolution venue will be determined by the governing law clause in the relevant commercial agreement. Parties will attempt good-faith negotiation before formal proceedings.

21. Changes to This Agreement

We may update this agreement to reflect service, legal, or policy changes. Updated versions are posted on this site with an effective date. Continued use after the effective date constitutes acceptance of revised terms, except where law requires explicit additional consent.

22. Entire Agreement and Severability

This agreement, together with the Privacy Policy and signed commercial documents, constitutes the complete understanding regarding covered services. If any provision is unenforceable, remaining provisions remain in effect to the extent permitted by law.
